Expiry Review – Dumping of Whole Potatoes from the United States

On April 1, 2026, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its order issued on June 2, 2021 (Expiry Review No. RR-2020-002), concerning the dumping of certain whole potatoes exported from the United States of America for use or consumption in the province of British Columbia.

As part of this process, the Canada Border Services Agency (CBSA) has initiated a corresponding expiry review investigation to determine, pursuant to paragraph 76.03(7)(a) of SIMA, whether the expiry of the order is likely to result in the continuation or resumption of dumping of the subject goods.

The CBSA will issue its determination no later than August 28, 2026, with a Statement of Reasons to follow by September 11, 2026.

The product definition and applicable tariff classification numbers for the goods subject to the CITT’s order are available through the CBSA’s Measures in Force.

As part of the investigation, the CBSA has distributed questionnaires to Canadian producers, importers, and exporters. Any parties who have not received a questionnaire but wish to participate are encouraged to contact the CBSA SIMA Registry and Disclosure Unit.

Responses to all questionnaires are due by May 11, 2026, and must be submitted through the CBSA’s ACE web application.
